Sub - AICCTU demands withdrawal of false and fabricated cases against
S. Kumarasami, National President of AICCTU in the case of death of
Mr. George, Vice-president of Pricol Ltd., Coimbatore; institution of
a high level inquiry into this incident and action against the Pricol
management for open violation of labour Laws, govt. orders and court
orders regarding the workers of this factory.

An unfortunate incident of death of Mr. George, Vice-president of
Pricol Ltd., Coimbatore has taken place reportedly during skirmish
when the workers’ representative were talking to the deceased against
dismissals of fellow workers.

It is shocking, however, that in this incident Mr. S. Kumarasami, the
national President of a centrally recognized central Trade Union
Organisation, AICCTU and a practicing lawyer in Tamil Nadu High Court
has been falsely implicated and named in FIR.

You are fully aware, and also earlier apprised of systemic and rampant
violation of labour laws, Government and Court orders and settlements
with workers apart from vindictive actions taken by the management of
Pricol Ltd., Coimbatore, Tamil Nadu towards workers. In particular,
the management has over the past two years consistently refusing to
talk to the union, and has threatened, victimised and intimidated
workers to leave their majority union led by AICCTU.

Locking out the workers, transferring them, depriving them of their
earned wages and other statutory benefits – all had become the
hallmark of the vindictive actions of this management since the
workers of this factory started expressing their plight and raising
their voice against unfair labour practices from early 2007 in totally
peaceful ways like fasting, badge wearing, dharna etc. The management
has a history of openly violating the govt. order of 24-05-2007
regarding 10 (B) and also subsequent High Court and Supreme Court
orders regarding the same and other matters.
Even the Labour Minister of your govt. in his reply to the Calling
Attention Motion in the state Assembly on 30th June 2009 raised and
spoken by MLAs of a host of parties like AIADMK, Congress, PMK, CPI,
CPI(M) regarding the indefinite fast (from 15-06-2009) of Pricol
Workers on their demands, narrated the various unfair labour practices
of the management as well as the actions taken by the government. He
concluded by stating that the demands of the workers are accepted and
their fast has ended. He also assured that the Government would never
let Pricol workers down.


In particularly last two months the Pricol management had deliberately
started targeting the women workers (shame!), and when the workers
started protesting against it by wearing protest badges inside the
factory during their working time, 43 workers were terminated on 21
September. Even then when workers continued to protest, the management
with the help of its goons attacked workers during talks between Mr.
George and workers’ representatives which, apparently, led to the
above unfortunate incident.

It is highly condemnable that S. Kumarasami, National President of
AICCTU has been implicated in this case by your police administration
which is nothing but in a planned manner targeting the national leader
of a recognized central Trade Union Organization, creating terror
among the workers and dissuading them from exercising their trade
union rights.

While we strongly disapprove of this unfortunate incident, we demand
institution of a high level inquiry in this incident along with
withdrawal of false and fabricated cases against S. Kumarasami,
National President of AICCTU and stopping of arrests and witch-hunt of
workers in this case. We also demand that the management particularly
the MD of Pricol Ltd. should be brought to book for open violation of
labour Laws, govt. orders and court orders regarding the workers of
this factory.
