*Condemn the ‘illegal’ attitude of a ‘legal personnel’! * *1. **Place of offence:* Sub Colletor’s Office, Rajahmundry, East Godavari District of A.P. *2. **Date of Offence:* 7th July, 2010 *3. **Offender/ Accused:* Madduri Shiva Subrahmanyam, Belongs to Brahmin community. He is a lawyer and the Convener of the ‘Adi Kavi Nannayya University Prangana Pariraxana Samithi (AKN U’verisity’s protection Committee). *A Brief note on formation of the committee**:* In the regime of the then CM Late YS Raja Sekhar Reddy; the foundation stone was laid for the above said University in Velugubanda village, where it is very near to Rajahmundry town. The land owners of the village disagreed to give their lands to the U’Versity and went to the court. So, the bureaucracy is trying to seek some other lands in some other village for launching of the U’versity in to avoid the delays. With this back ground; the above said ‘protection committee was started. *4. **Complainant:* Kona Sashidhar, Joint Collector of East Godavari District of A.P. *5. **Case filed:* a case was registered in the III town police station of Rajahmundry under *SC, ST Prevention of Atrocities Act; 1989 & IPC 506. * *6. **Charged Framed: **insult, intimidation and humiliation *under section *3 (1) (x)* of SC, ST PoA; and abduction of the Government servant from the deliverance of his duties under section 506 IPC. *7. *[image: C:\Documents and Settings\Administrator\My Documents\My Scans\2010-07 (Jul)\scan0009.jpg]T*he scene- (In brief): * On 7th July 2010; the u’ versity protection Committee under the leadership of Mr. Madduri Shiva Subrhmanyam (Accused) approached the Joint Collector (JC- Complainanat)) to represent on the issue of relocate of the university from former planned Velugubanda village to some other village. Mr. Shiva Subrahmanyam alleged the JC on the delays happening in land procurement for the university. The two had had heated discussions. In that context; the accused abused the JC by caste name and humiliated him in the presence of other Cilvil Societys’ representatives and his subordinates. The accused abused “after all you- the SC candidate – got this job by bloody reservations, your total monthly salary could not equal to my two hours income; how can you compete with me in talking like this” (this version did not come out in the print media- but the confidential sources saying). *By hurting by these words;* the JC gave a written complaint against the accused to the local police on the spot. *Mr.* Undavalli Arun Kumar- who is also belongs to Brahmin community; the local MP; A noted translator for Gandhi’s family; earlier he renowned for his allegations on Babasaheb Ambedkar ; – and the Ex Minister, Mr. Jakkampoodi Ram Mohan Rao, and who is renowned as the right hand for the then CM late YS Rajasekara Reddi put their full efforts to prevent the accused from the arrest; but futile. *At last, the accused was arrested by the local DSP on Thursday night; and put behind the bars of Rajahmundry Central jail.* * * *B. Protests both from the Revenue Department and the Dalits: *Immediate after the complaint given by the JC; the news wide spread like a wild fire and the whole department of the Revenue and various sections of Dalits (irrespective of sub caste feelings) flooded over the streets and expressed their solidarity to JC on this issue and protested the attitude of the Lawyers. The Dalit Lawyers are also came front to condemn the issue. ** * * *D. So, the prosecution filed a petition on 11th July in the special court asking for the cancellation of the bail. They are condemning the grant of bail for the accused and demanding for the cancellation of the same. If you remember, The Supreme Court of India acquittal the most brutal case in the history of A.P.- Karamchedu Massacre case - by failure of the ‘prosecution’ in showing reliable evidences in the case!!! * The History repeated here also - *the special court on SC, ST Atrocity cases rejected to file the petition,* which was filed by the prosecution for the cancellation of bail for the accused, which was granted earlier. Alas! We are also familiarized to see the biased attitude of the ‘Legislations’ ‘executions’ and the ‘judiciary’! *The Demands of the JAC:* · The Bail should be cancelled for the accused; · The membership of the accused in the ‘Bar Council’ must be cancelled; · The accused must expelled from the Convener ship of ‘AKNU Protection Committee’.
