A general election for the Constituent Assembly (CA) was held in Nepal on 10 April 2008.None of the parties succeeded in getting a simple majority in the CA. The Nepalese Constituent Assembly<http://en.wikipedia.org/wiki/Nepalese_Constituent_Assembly>will draft a new constitution, it will therefore decide, amongst other things, on the issue of federalism <http://en.wikipedia.org/wiki/Federalism> . To prepare a draft of constitution and ratify if after discussion, to conform the issues to be decided through referendum, to take decision on republic through the first meeting of the constituent assembly, to decide state's restructures in accordance with the federal form and to work as legislative parliament are the major function of constituents assembly. While the CA has the prime responsibility of drafting a new constitution for Nepal, it also functions as a regular Parliament. Through the fourth amendment to the interim constitution of Nepal on May 28, 2008, the CA also established, for the first time, a largely ceremonial President as the constitutional head of state, as well as a Vice President. The Prime Minister continues to be the head of the government. They agree to draft the new constitution within two years. But due to the instability of the government and conflict among the parties, the main task to draft the new constitution could not complete in two years. So at the end of the maturity date main three political parties agree to extend time for 1 year on May 28, 2010. Same process repeats this year too. Due to the conflict between Maoist, Congress and other parties to choose the Prime minister, they obstructed CA assembly many times. So to draft the Constitution and logical end of peace process could not complete this year too. At the end of the day 28 May 2011 they deal in following five points and agree to extend the time period for 3 months 1. Completion of fundamentals of the peace process within three months 2. Preparation of the first draft of the new constitution within three months 3. Implementation of past agreements with the Madhesi Morcha by developing Nepal Army as an inclusive institution 4. Extension of the Constituent Assembly term by three months 5. PM's resignation to pave way for formation of a national consensus government. People are very optimistic at the election of the CA. But due to the carelessness, instability of the government, people are fear as if new constitution will not draft. Human rights commission, Civil Society, Non government organization, small political parties are strongly giving pressure to major three political parties to concern the task. All people of Nepal are willing to see the new day with new constitution.
