*Ahmedabad:* Zakia Jafris counsel on Thursday accused the Supreme
Courtappointed special investigation team (SIT ) of not investigating the
charges against chief minister Narendra Modi,as part of an on-going
conspiracy.Opposing the SITs clean chit to Modi and others on allegations
of a larger conspiracy behind the post-Godhra riots,senior counselMihir
Desaisubmitted before metropolitan magistrate B J Ganatra that the way the
SIT deliberately ignored pieces of evidence and didnt take these on
record,he suspected the SIT was conspiring to shield the accused of the
2002 riots,sourcessaid.

Desai gave examples of statements recorded by SIT,which didnt question
witnesses with regard to evidence already on record.Hecitedtheexample of
inflammatory leaflets circulatedin Vadodara city during the riots.This had
come to the noticeof IB,which reported ittothe government.Theseleaflets
bore the names of VHP functionariesbutthe SITdidnt ask these VHP leaders
any questions when they were interrogated,Zakias lawyer submitted.The
advocate argued that the probe agency conducted its investigation in an
improper manner andthis raises doubts on the agencys intentions.SITs
counsel R S Jamuar reacted strongly to this and accused Zakia of digging up
the past to spread communal hatred again,more than a decade later.TNN

Zakia Jafri, widow of Ahsan Jafri who was killed during the 2002 Gujarat
riots, Friday said the Special Investigation Team (SIT) didn't acknowledge
certain documents as evidence in the Gulberg massacre case which showed
that SIT was a part of the conspiracy. Zakia further alleged that SIT was
not probing Jafri's case "seriously".

During the ninth day of argument against the SIT's final report that gave
clean chit to Chief Minister Narendra Modi and others for their alleged
complicity in the larger conspiracy that led to statewide riots, Jafri's
lawyer Mihir Desai told the court that SIT ignored various aspects which
were sufficient to take cognizance of the case.

The allegation of conspiracy led to a heated argument between SIT lawyer R
S Jamuar and Desai. "This is an uncontrolled argument. If SIT is also a
conspirator then Zakia should make SIT chairman R K Raghavan and its
members, A K Malhotra and IPS officer Himanshu Shukla, accused in the
case," Jamuar told magistrate B J Ganatra.

Earlier, Desai argued that the administration ignored intelligence messages
while communal tension was rising, following the arrival of dead bodies of
victims of Sabarmati Express train carnage in Ahmedabad and was allegedly
paraded at processions to create communal tension.

Desai submitted various pamphlets, allegedly distributed by Hindu outfits,
appealing the Hindus to boycott people from the minority community socially
and economically. These pamphlets, according to Desai's submission, were
part of a conspiracy which the state government, despite being aware of it,
ignored.

"SIT member A K Malhotra reported the contents of these pamphlets in his
first report filed before the Supreme Court. However, in the final report,
the SIT completely ignored it, saying these pamphlets didn't contain the
publisher's name. In fact, SIT recorded statements of VHP members,
including Pravin Togadia, Jaydeep Patel, Hasmukh Patel and Kaushik Mehta.
However, SIT never asked them about these pamphlets," Desai submitted.

He said that these objectionable pamphlets were first brought to the
attention of the Additional Director General of Police (Intelligence) by a
Superintendent of Police in Vadodara. The ADGP reported it to Director
General of Police and state Home Department. Desai said that the then
Additional Chief Secretary to Chief Minister, Ashok Narayan, had said in
this statement that he had discussed it with Modi. "However, SIT never
bothered to take these accounts seriously. SIT failed to probe these
pamphlets... all these are part of conspiracy," Desai concluded. The
hearing will resume from August 1.
