COMMENTS ON NEW LAW ON SEXUAL HARASSMENT OF WOMEN AT WORKPLACE
IN INDIA ( CAME IN TO FORCE ON 09.12.2013)
            One wonders whether the new law will strengthen the protection
of women's rights at workplace in the state of Tamil Nadu for the following
reasons:
1. Every offence under this Act is made a non-cognisable one under Section
27(3) thereby making police unable to register the complaint or arrest the
accused except as ordered so by the competent court. Now, police are
registering complaint against the accused under Women Harassment
(prevention) Act which is cognisable.

2. Therefore, the deterrent effect of immediate arrest and custodial
interrogation is lacking in the new law.

3.  Section 14 of the new law may deter the victims from preferring
complaint since it prescribes punishment to women for the 'false complaint'
or 'false evidence'.
