Esto para aclarar donde est� la pol�mica de la licencia YaST.
Aclaro que yo s� acepto que toda interpretaci�n de mi parte es s�lo eso:
interpretaci�n, no pretendo "dictar sentencia" sobre la interpretaci�n
v�lida de la licencia, cosa que no estoy preparado para hacer (as� como el
resto de los usuarios del grupo tampoco est�n capacitados a hacerlo a menos
que est�n dictando sentencia en alg�n caso a este respecto, si son jueces,
lo que no har�an aqu�)
Creo que queda a juicio de cada uno que est� dispuesto a hacer y a juicio
del sistema judicial (de existir demandas por parte de alguna parte
interesada) resolver sobre estos puntos si alg�n d�a se ve obligado a
hacerlo, dado que un juez podr�a llegar a invalidar una licencia al dictar
sentencia, y si esto sucede en la �ltima posible apelaci�n la licencia misma
podr�a quedar invalidada hasta nuevo aviso (hasta donde entiendo: hay leyes
enteras que han quedado suspendidas por inconstitucionalidades y eso lo se
porque lo hemos vivido en este pa�s, si no recuerden cuando estuvimos sin
ley de tr�nsito).
En cuanto al ente GULCR, los responsables legales son los que tienen que
tener claro que est�n dispuestos a hacer, dado que ellos son los que podr�an
sufrir las consecuencias de existir un error en cualquier interpretaci�n de
cualquier licencia al redistribuirla. Enti�ndo completamente cualquier
negativa a, oficialmente, involucrarse en la redistribuci�n de licencias
sobre las que haya cualquier tipo de duda.

[Ciro Guerra Lara] Aqu� es donde expl�citamente se prohibe
la distribuci�n de transportadores de datos no gratuita. El punto es que
este p�rrafo pretende permitir la distribuci�n gratuita al prohibir
solamente la distribuci�n no gratuita, dado que el p�rrafo pierde todo
sentido si solamente est� prohibiendo lo ya prohibido sin otorgar ning�n
derecho.
La objeci�n planteada en esta lista es que, si todos los
derechos estaban previamente limitados los derechos de redistribuci�n
gratuita tambi�n y que este p�rrafo no adjudica ning�n derecho adicional.
A mi juicio est�n extrapolando conceptos. La licencia
prohibe expl�citamente el lucro mas no prohibe ning�n tipo de distribuci�n
gratuita, otorgando derechos de copia gratuita a los usuarios. Esto lo digo
despu�s de haber consultado con SuSE y haber recibido confirmaci�n sobre
este punto, aunque usuarios de esta lista invalidan esto poni�ndo en duda
dicha respuesta de SuSE.
Ellos sostienen que no se otorga ning�n derecho de copia
gratuita en este p�rrafo.
Yo sostengo exactamente lo contrario y parece ser la
interpretaci�n preponderante en la red, de acuerdo a lo que yo he le�do y he
citado con anterioridad.
No soy juez y el resto de los usuarios de esta lista tampoco
para poder "dictar sentencia" sobre que dice la licencia, aunque algunos
crean lo contrario.

[Ciro Guerra Lara] Aqu� lo que se pretende es aclarar que
al distribuir a trav�s de estos transportadores de datos espec�ficos es
necesario verificar las licencias del software espec�fico, dado que, al
distribuir cierto software por separado de la distribuci�n completa pueden
incurrirse en infracciones de los paquetes de software espec�ficos sin estar
cubierto por la licencia YaST.
La objeci�n planteada en la lista es que s�lo se permiten
estos transportadores de datos, haci�ndo superfluo el p�rrafo anterior.

[Ciro Guerra Lara] Un punto adicional es si el software que viene inclu�do
en la distribuci�n se est� distribuyendo en su totalidad bajo YaST o GPL o
si hay licencias adicionales que limiten la distribuci�n.
De acuerdo a lo que he logrado entender: al redistribuir SuSE Linux en su
totalidad, la distribuci�n viene amparada por YaST, con conocimiento previo
de los proveedores del software adicional. Si se van a distribuir paquetes
individuales, hay que verificar la licencia del paquete de software en
cuesti�n (de aqu� es de donde surge el problema de los ftp's y maiboxes).
De acuerdo a algunos otros usuarios de esta lista esto no es correcto y hay
que verificar las licencias de cada paquete por aparte, seg�n enti�ndo.
En todo caso, s� hay alternativas que son totalmente GPL (Debian GNU/Linux
ser�a la "m�s libre" hasta donde enti�ndo) para aquellos que duden de otras
licencias y prefieran quedarse con GPL.
Estas alternativas NO SON t�cnicamente inferiores ni mucho menos, en algunos
casos son muy recomendadas por muchas personas (y no s�lo por los usuarios
de esta lista).
Si hay algo que abunda en este momento son las distribuciones de Linux.
