New Delhi: Two Bharatiya Janata Party (BJP) legislators yesterday ceased to be members of the Goa assembly, with the Supreme Court refusing to extend a stay on their disqualification order.
The apex court declined to stay the operation of a judgement of the Goa bench of the Bombay High Court unseating the legislators on the ground that they were holding office of profit at the time of contesting the May 2002 Assembly polls. A vacation bench comprising judges D M Dharmadhikari and S H Kapadia, however, issued notice on two petitions filed by Goa BJP legislators Dayanand Rayu Mandrekar and Rajendra Vishwanath Ariekar, challenging their disqualification. The court issued a notice to two Nationalist Congress Party candidates - C U Chodankar and Jose Philips DSouza - on whose petition the Panaji bench of the Bombay High court had disqualified Dayanand Rayu Mandrekar and Rajendra Vishwanath Ariekar, saying the case needed to be heard in greater detail. While Mandrekar was the chairman of the Khadi and Village Industries Board, Ariekar held the post of chairperson of the Goa State Scheduled Castes and Other Backward Classes Finance and Development Corp. In their petition in the Supreme Court, the two BJP leaders said the high court had erred as it had failed to consider that for an office of profit, it was essential that remuneration or any benefit involving an element of profit or pecuniary gain should be attached to the office.
