First, the legislatures are dominated by attorneys so you have a confilict
of interst already. Second, one part is supported by trial lawyers.
you made the comment that in the jaws freedom box sham that both sides
settled out of court and benefitted. i don't see how freedom box benefitted
at all. jaws got waht they wanted which was to have freedom box change the
name even though jaws was clearly in the wrong. Freedom box had the name
before freedom scientific was formed. Also freedom scientific shares part
of their name with scientific atlanta as an example. you can't have one
without the other. if freedom box is in violation then so is freedom
scientific. freedom box chose to change the name to avoid going to court
and so jaws got their way. They now hope to accomplish the same with
gwmicro. They know the patent has not been violated but they hope that it
want go to a court and that gwmicro will remove the feature.

One other interesting thought:
When FS introduced this marker technology and WE customers asked why WE
didn't have it, one of the comments made was its unreliability for reasons
you have explained.
Granted, those comments were made, to some degree as puffery designed to
downplay a marketing advantage JFW had at that time and place.
GWmicro, of course, understood the value of the concept else they would
not have attempted to introduce it in 7.0.
What's sad in all this, and I feel Doug's pain in his blog entry, is that
a software developer must have some legal training (or have his work
reviewed by someone) in order to protect himself. By nature and
inclination, it is obvious why software developers rather not have to take
this step. Moreover, if they routinely had to do this, they would worry
if their intellectual property could end up compromised by an attorney who
was less than scrupulous himself.
Perhaps things aren't as bad in your homeland of New Zealand, but here
stateside, I see the legal profession dominating the business world to an
inordinate degree.
