Elementary, my dear Watson. The spell checker is always working. Some emails contain spelling errors or words the spell checker doesn't recognize as words, so the spell checker opens the spell check dialog. Other emails are checked by the spell checker and found to be free of errors, so the spell checker does not open a dialog.
