Being Scottish isn't like having venereal disease - there's a limit to how far you can take it with you!
A Canadian, or someone living in Canada, would be covered by Canadian laws regarding marriage, and someone in London, England (as opposed to London, Ontario) would is residing in Britain and is covered by British law. It wouldn't matter a fiddler's fornication if you were Scottish or Lebanese, as I understand it. The late 19th century is pretty "modern" in my opinion - they're getting pretty tight-assed about marriage. I can't see it being legal or acceptable, but if it's a novel, well....I would recommend checking British AND Canadian law. I have a book on the history of marriage in Canada, and came across no mention on marriage by correspondence.
