This test-case works for me with version 1.3.175:
create table t1 (dat DATETIME NULL DEFAULT CURRENT_TIMESTAMP, item int);
insert into t1(item) values (1);
insert into t1(item) values (1);
insert into t1(item) values (2);
insert into t1(item) values (2);
select * from t1 where dat in (select max(dat) from t1 group by item);
So unless you have a self-contained test case, I cannot help you.
