As you know, there are strict rules regarding what work government employees can or cannot do on the outside. If and when any government employee is put forward as a candidate to work on this project they will have to comply with these rules and go through the necessary approval process. Each individual will be treated on a case by case basis. We have clearly identified what the rules are and the process needed to comply with them in collaboration with CMS, Iowa Foundation for Medical Care and the VA general counsel. In fact, the contract requires that WorldVistA will comply with all Federal rules and regulations that apply.

If this is true, I'm betting that particular law, is violated frequently.
The way I would see this, which may not be the way the judicial system sees it, is, if a person has influence over the placing of the contract by virtue of his/her position in the gov't, and moonlights with the company that received
the contract, then it would be a conflict of interest.
Otherwise, I'd see it as being a "hand away", and therefore no conflict.

That's not the point. The point is that HHS is paying for a *support contract*. Whether the support is offered to federal agencies or the private sector is a different issue. I'm not a lawyer, but the fact that this is a contract and not a grant, raises all kinds of red flags.
