There is a case where an firewall appliance maker ,I forget who, that is
going to court over their use of Linux on the appliance.

Unfortunately Cameron, Microsoft does not release its software under the
GPL. And selling an appliance with their software without paying the
fees is illegal.

That is not the case with the GPL.

There are companies *TODAY* doing just what I am talking about. It is
legal (although unethical a bit IMO) but it is totally legal.
