It's not so much a consumer thing but rather an essential services thing. The Telecommunications Act here clearly states that all homes must have a phone line in the premises and all lines must have at least access to emergency services even if the line is otherwise disabled to the consumer.
I don't know how Texas expects to succeed in court given that Vonage were working within FCC regs. It's a shame, but at the same time, hopefully it will prove to be a valuable lesson to all telcos.
