I'm not sure that the HW is a requirement from MS, some DSP OEM's sell without the HW. May be up to the individual vendor. Makes no sense since MS does not make HW ( well other then input devices AFAIK )

To legally buy OEM versions of software you generally need to buy hardware at the same time right?  And am I also correct in thinking you can't resell them without an OEM agreement with Microsoft?  I'm a novice in this

I have seen Windows XP Home OEM kits shipped with one screw (to qualify as the hardware) to customers. Microsoft says the COA should not be sold by itself. Ok, just toss in a CD and a screw and you are legal. My supplier, ASI requires that I either purchase a 3 pack or purchase hardware such as a hard drive or motherboard to go with a single.
