I think you're talking at cross-purposes: you're talking about whether
it's legally safe to link to this library, whereas Kaz is talking about
whether MS makes any promise about the contents of this library
(i.e. whether it's technically safe to link to it).

IIUC it's definitely legal to link to it, and while MS would like to
have a free hand in what it puts into this library, in practice the
marketplace pressure to ensure backward compatibility appears to be
sufficient to make its use technically safe so far.
