It's legal to keep dog tethered outside

Q: My neighbor keeps his pit bull chained to a tree, but the yard isn¹t
fenced. His house is next to a day care and kids walk past every day. The
dog seems to have a temper. What¹s the law about dogs, especially pit bulls?
Shouldn¹t he be inside a fence? ‹ J.H., Fayetteville

A: Should be and has to be are two different things.

Maybe the dog should be kept behind a secure fence. But he doesn¹t have to
be. No state law or local ordinance requires dogs ‹ or pit bulls,
specifically ‹ to be contained in fences if they¹re kept outside. And no law
prohibits tethering dogs ‹ though they can¹t be tethered to the point that
they can¹t reach their food, water or shelter.

So your neighbor¹s actions are probably legal.

But they may not be advisable. You can call the Cumberland County Animal
Control Department and tell them about the situation. They¹d send a staffer
to talk to your neighbor about the liability problems he would face if his
dog hurt someone who wandered into his yard.

³We provide that service to anyone,² said Sue Nicholson, who directs the
department. ³We¹re pretty good at persuading people.²
