I just read about this at the Swedish "Data Inspection" that handles these issues here in Sweden. It clearly states that it IS okay to transfer data to "3rd countries" if it is approved by the user registering. So... I guess you can just put information about this in the Terms & Conditions at sign up. But maybe that's just in Sweden...
