Military Court Clears 3 British Soldiers June 6th, 2006 @ 4:27pm
COLCHESTER, England (AP) - A military court on Tuesday cleared three British soldiers of killing an Iraqi teenager who drowned after allegedly being forced into a canal.
A panel of seven military jurors acquitted Sgt. Carle Selman, 39, Guardsman Joseph McCleary, 24, and Guardsman Martin McGing, 22 of manslaughter in the death of 15-year-old Ahmad Jabbar Kareem, who drowned in the Shatt al-Basra canal in Basra in May 2003.
Last month, Vice Judge Advocate General Michael Hunter found a fourth soldier, Lance Cpl. James Cooke, 22, not guilty of manslaughter.
Prosecutors alleged the teenager and three other suspected looters were forced into the water to "teach them a lesson."
Soldiers testified during the five-week trial that "wetting" looters was common practice at the time, shortly after British troops had gained control of Basra, and that it was considered the minimum force necessary under the circumstances.
Prosecutor Orlando Pownall said the actions of the four soldiers "fell significantly and unlawfully outside what could be described as minimum necessary force."
A senior army officer told the court that British troops in southern Iraq had lacked the resources to occupy the country properly.
"There was a total failure to plan for the occupation," said Lt. Col. Nicholas Mercer, the army's senior legal officer for the invasion. "There was only enough time to prepare for war, never mind the occupation.
"It was not foreseen that Iraq would implode to the extent that it did. What ensued was unique in modern postwar conflict. It was subsequently described as a strategic failure," he said.
"There were simply insufficient troops to carry the responsibilities of an occupying power in a belligerent occupation."
A Ministry of Defense spokesman, Col. Peter Davies, said British soldiers "are not above the law and must operate within strict legal guidelines at all times."
"The army takes all allegations of failure to do so extremely seriously," he said.
"It's only right and proper that those allegations are fully investigated and, where appropriate, the evidence tested in court.
"In this case, that process is now complete and the soldiers are able to resume their military careers with the continuing full support of the Army and their regiments."
