KUALA LUMPUR, Jan 28 (AFP) - Sacked Malaysian politician Anwar
Ibrahim told his
sex trial Friday that a record of his official engagements in early
1993 -- ranging from a
Mickey Mouse on Ice show to an Islamic reception -- proved he could
not have
sodomised his driver at the time.
Anwar, using an official record of his program when finance minister,
gave details of his
movements and the names of people accompanying him for the period
stipulated in the
charge.
Defence lawyers said current finance minister Daim Zainuddin would be
called as a
witness later.
Anwar and his co-accused Sukma Darmawan are charged with sodomising
driver Azizan
Abu Bakar at Sukma's apartment on "one night at 7.45 p.m., between
January and
March, 1993."
Prosecutors earlier in the trial had twice amended the charge to
change the year of the
alleged offence, despite defence objections.
The defence is trying to establish an alibi from February 11, saying
the bed on which the
act allegedly took place was only delivered on February 12.
Prime Minister Mahathir Mohamad sacked his heir apparent Anwar as
finance minister
and deputy premier in September 1998. He was detained later that
month after leading
mass anti-government protests.
Last April Anwar was jailed for six years for abusing his official
powers to cover up
allegations up sexual misconduct. He says he is the victim of a
high-level conspiracy.
He could face a 20-year jail term if convicted of sodomy.
Anwar said he was away in Europe from February 4, 1993, and returned
on February 14.
He named Daim and Ali Abul Hassan Sulaiman, now central bank
governor, as being
among his entourage.
On February 16, he said, he hosted a dinner for a delegation from the
Organisation of the
Islamic Conference. He said he left home at about 7.40 p.m and the
function ended about
10.45 to 11 p.m.
On February 17 Anwar said he attended a poetry recital and the
following day he
watched a Mickey Mouse on Ice skating performance at the time of the
alleged offence.
"On February 21 I left for Penang and on 23rd I went to Bangkok for
the ASEAN
Finance Ministers' Meeting and returned to Kuala Lumpur (the same
day), which was
the first day of the Ramadan (Muslim fasting) month," he said.
The defence says it needs not show an alibi for weekends and Mondays,
as Azizan had
earlier testified he was sodomised on a working day and that the
previous day was also
a working day.
Anwar also said he need not account for Fridays, based on Azizan's
earlier testimony.
Azizan had also told the court he had lunch on the day he was
sodomised. The defence
says this ruled out the Ramadan month, which lasted from late
February to late March in
1993.
Muslims must not eat between dawn and dusk during Ramadan.
Anwar said that on March 26, he celebrated the feast of Eid-al-Fitr
marking the end of
Ramadan in his home town in Penang state.
"I was in Penang from March 24 to 29. I returned to Kuala Lumpur late
March 29, after
attending a meeting of the United Malays National Organisation," he
said.
Anwar said he held a Eid-al-Fitr party at his residence on March 30
and on the following
day attended a dinner at the home of Abdul Hamid Abu Sulaiman, rector
of the
International Islamic University.
"Every day at 7.30 p.m., I perform the Maghrib prayers," he added.
The trial was adjourned until Wednesday after Anwar finished giving
alibi evidence.
Sukma's lawyers along with prosecutors are expected to cross-examine
Anwar.
Anwar's lawyers are then expected to call witnesses -- including
senior civil servants --
to support the alibi defence during their re-examination.
Lead counsel Christopher Fernando tolf AFP the defence would summon
witnesses
including Daim to prove Anwar did not commit the alleged offence.
"They will be called after the prosecution finishes the
cross-examination," he said
outside the courtroom.
