Anwar's lawyers unsure if Mahathir has received affidavit
KUALA LUMPUR, March 20 (AFP) - Lawyers for Malaysia's Anwar Ibrahim said
Monday they did not know whether Prime Minister Mahathir Mohamad had
received a crucial document seeking his testimony in the sodomy trial.
When the trial resumes Wednesday, Judge Arifin Jaka is due to rule on
defence demands that Mahathir give evidence in the trial of his sacked
and
jailed former deputy.
Anwar, in an affidavit which he filed personally with the High Court
this
month, said he was convinced Mahathir had evidence "to show I am
innocent"
and listed 20 reasons why his testimony was crucial.
Anwar says he is the victim of a political conspiracy.
His lawyers told AFP there had been "no notice" from the
attorney-general's
office to indicate whether Anwar's affidavit had been served on the
premier.
"The AG's office had agreed in court to assist in serving the affidavit
on
Mahathir ... but Anwar has no notice or knowledge that it has been
done,"
said Pawancheek Marican, a member of the defence team.
Lead defence counsel Christopher Fernando on March 13 asked for the
trial
to be adjourned to give Mahathir time to reply to Anwar's affidavit.
Another lawyer, Sankara Nair, said Anwar had filed the document
personally
to avoid creating any problems for his legal team.
"He wanted to do it himself to avoid possible action (against his
lawyers)
on any contentious issues in the affidavit and we agreed to go along
with
him," Sankara said.
Karpal Singh, another member of Anwar's legal team, which is providing
its
services for free, has been charged with sedition over a remark he made
in
court earlier in the trial.
Anwar and his adopted brother Sukma Darmawan are charged with sodomising
Azizan Abu Bakar, then the driver for the politician's wife, between
January and March 1993. The charge carries up to 20 years' jail.
Anwar is already serving six years for abusing his official powers to
cover
up allegations of sexual misconduct.
Sukma's lawyers last October served a subpoena on Mahathir and Anwar's
attorneys later followed suit.
The prosecution objected and last month Judge Arifin Jaka said he would
only order Mahathir to take the stand if he was satisfied his evidence
would be relevant.
Mahathir has said he will testify if required, but suspects a "political
stunt."
