Anwar judge blocks PM testimony
Mahathir Mohamad says he will appear if required


A judge in Malaysia has said he will not order Prime Minister Mahathir
Mohamad to testify in Anwar Ibrahim's sodomy trial unless defence
lawyers
can prove he helped frame his former deputy.

"You must convince me that Dr Mahathir played a role in fabricating
charges
against Anwar Ibrahim," Judge Arifin Jaka told the court as the trial
resumed after a month-long break.

"Toppling one another in politics is common. It happens day to day," he
said.

But Judge Arifin warned that, should defence lawyers prove involvement
by
Dr Mahathir, he would have no compunction in ordering him to testify.

"If there is evidence before me, I will say with all my conscience that
the
prime minister will have to come here. I will not protect him."

Affadavit

Judge Arifin was referring to a defence request that Dr Mahathir be
called
as a witness in the 10-month trial that has split Malaysia's ruling
party.

In an affadavit filed last week, Mr Anwar said he believed Dr Mahathir
gave
orders to officials to fabricate sodomy charges that led to his sacking
in
September 1998 and subsequent six-year jailing for corruption.

His lawyer told the court that Dr Mahathir was a crucial witness for the

defence.

Mr Anwar, 53, is accused of sodomising his former family driver in 1993,
a
charge he denies and for which he could face another 20 years in jail.

He also faces four other sodomy counts and one corruption charge, which
he
also denies.

The former deputy premier says he was the victim of a political
conspiracy
by associates of Dr Mahathir, who wanted to prevent him from ever
attaining
power and exposing corruption and cronyism.

The judge's ruling means that Mr Anwar's lawyers will have to prove not
only that Dr Mahathir played a part in an alleged political plot, but
also
that he was directly involved in fabricating the sodomy charges.
