Fernando said if the applications by Finance Minister Daim Zainuddin and Deputy Education Minister Aziz Shamsuddin were successful, it would considerably weaken Anwar's defence of an alleged conspiracy framed by Prime Minister Mahathir Mohamad's aides to topple Anwar from power by fabricating sodomy charges against him. Yesterday, High Court judge Arifin Jaka told Anwar's defence team that he will make a ruling to call Mahathir to court only if the defence can show that the premier was personally involved in fabricating sexual charges against his former deputy. Testimony from Aziz or Daim would help the defence to corroborate the alleged high-level conspiracy and fabrication of sex details to topple former deputy prime minister Anwar. Daim, in his motion filed yesterday, said he "does not have any personal knowledge of any person or persons who is or are planning to topple Anwar politically or kill his political career." "I am in no position to give any relevant or material evidence in the determination of the guilt or otherwise of Anwar or Sukma," Daim added. Anwar and adopted brother Sukma Dermawan Sasmitaat Madja stand trial for sodomy and sexual misconduct. Sukma faces an additional charge of abetting and aiding Anwar to force sex on ex-driver Azizan Bu Bakar. The motion filed by Aziz, who is also Mahathir's former political secretary, states he is "not acquainted with the circumstances of the case". "My presence, if required, is a vexation and a flagrant abuse of the process of court," Aziz said. Fernando said they will counter both the motions next Tuesday before Arifin. "Our point is that they (Daim and Aziz) will be able to throw considerable light in this case. Their names have been mentioned by witnesses," Fernando said. Defence witness Raja Kamaruddin, who is an ex-commando and former Umno branch head, told the court last month that he was instructed by Aziz to spread rumours about Anwar's sexual misconduct to members of the ruling Umno and in particular Anwar's supporters. Star witness in Anwar's corruption trial, Ummi Hafilda Ali, told judge Augustine Paul that she had met Daim and Azizan said he met Mahathir regarding the sexual and sodomy allegations on Anwar. Meanwhile, Anwar's sodomy trial was postponed this morning due to a power failure in the court complex. The trial is to resume next Monday, where the court will hear further submission from lead prosecutor Abdul Gani Patail on the relevance of calling Mahathir to court as a defence witness. Upon orders from Arifin, Anwar filed a 10-page affidavit stating Mahathir's evidence is crucial in highlighting the conspiracy theory to topple him. Defence also served a subpoena on the premier last October. The defence also pointed out that Mahathir himself did not attempt to set aside the subpoena or challenge the affidavit through his counsel. "Like Aziz and Daim, he (Mahathir) should appoint a lawyer to object being produced in court rather than getting the public prosecutors to act on his behalf," Fernando said. He added that the public prosecutors are apparently acting on behalf of Mahathir to prevent him from coming to court. Anwar currently is serving a six-year jail term for corruption.
