SG. NIPAH SETTLERS SUE DISTRICT OFFICER(DO) , POLICE AND DEVELOPERS

This morning, T.Mohan , the chairperson of the Sg. Nipah settlers
Committee led twenty other settlers from Sg. Nipah to file a case under
Rule 8 of the High Court order,1980 against five people whom the
settlers feel have misled the court in obtaining an eviction order
against them.
Last year June 28th, 82 houses from Kampung Sg. Nipah was forcefully
brought down by the Developers, gangsters, police force and the Land
Office. In the same operation, 55 people from Kampung Sg. Nipah and some
PSM members including its Chairperson, Secretary General and Treasurer
were all arrested in the biggest arrest in recent years in an eviction
exercise. Six people have since be charged in the court for unlawful
assembly. The eviction operation was carried out in the most cruel way.
The police acted like gangsters while the gangsters acted like police in
numerous occosian till the settlers saw them both as one. The Settlers
who put up massive resistance for more than three months finally left
the land after armed gangsters paid by the developers assaulted key
leaders. This was not the end of the story, the Sg. Nipah settlers than
launced several attack from outside to seek justice.
Justice never came to them. More than 100 police reports were lodged,
matters were brought up to the Housing Ministry and Chief Minister but
there seems to be no solution. The capitalist seems to be just too
powerful and too well connected. The Sg. Nipah settlers among their
action demonstrated at the Chief Minister's Office, ACA Building and
even outside the Supreme Court. The Sg. Nipah settlers received a Human
Rights award during the SUARAM annual dinner for their untiring effort.
Today, the Sg. Nipah resident hit back at five people whom they claimed
to be involved in this conspiracy against the poor settlers. The five
are Abdul Malik and Tuan Haji Imran from the Land/District Office,
Acting Shah Alam OCPD Supt. Zulkapli bin Ahmad and two developers Hassan
Bin Taib and Lim Yew Loong. Hassan Bin Taib is the brother of the former
Chief Minister and current UMNO Vice President, Muhammad Taib. In the
case filed today by 81 settlers from Kampung Sg. Nipah, they claimed
that the five gave false evidence in the eviction proceeding which
resulted in their homes for 40 years being demolished within two hours.
The main contention of the suit was that the statement made in court by
the Asst. District officer Abdul Malek who said that the land is a state
land in an affidavit dated 12th. March 1999. The biggest lie has been as
early as 24th. January 1998, the Developer (Private Owner) has already
mortgaged the land to Multi-purpose Bank. Based on this statement, the
court declared the land as state land and in the process declared the
eviction notice legal and evicted the people.
Settlers also said that the struggle is far from over. The developers
think they have defeated us but we will always come back and haunt them.
They cannot get away with this crime.
V.Selvam, PSM Central Committee member who was at the High Court with
other PSM members said that the culprits must be punished at all cost.
The people have lost everything and now it is time to win back
