FLORIDA JUDGE REJECTS SECRET EVIDENCE
Ruling says Dr. Mazen Al-Najjar's constitutional rights were violated
(WASHINGTON, D.C., 6/1/2000) - A federal judge in Florida ruled on Wednesday 
that Dr. Mazen Al-Najjar's rights were violated when he was jailed through 
the use of secret evidence.

Today's St. Petersburg Times reports:

"In the most significant legal breakthrough for the former University of 
South Florida teacher since his arrest three years ago, the judge implied 
that immigration officials should make public their secret evidence against 
Al-Najjar, so he can respond, if they want to keep him in jail.

"U.S. District Judge Joan A. Lenard ordered the Immigration and 
Naturalization Service to have a new hearing to decide if Al-Najjar should 
get bail and be allowed to rejoin his family while he appeals a deportation 
order...

"...Al-Najjar, a Palestinian who has lived in the United States almost 20 
years, has not been charged with a crime. He was ordered deported for 
overstaying a student visa and was denied bail during his appeal, after the 
government introduced secret evidence it says links him to terrorists...

"...The 43-year-old father of three is one of about two dozen immigrants 
involved in secret evidence cases nationally. The immigrants are almost all 
Arab or Muslim. Supporters say they are the victims of prejudice and 
politics.

"In three recent cases in New Jersey, New York and California in which some 
of the secret evidence was released, immigration judges reversed themselves 
after the immigrants rebutted the allegations..."

"Once again, we see that when a court has the opportunity to address the use 
of secret evidence, the practice is found to be unconstitutional," said CAIR 
Communications Director Ibrahim Hooper. Hooper also said CAIR is calling on 
Muslims nationwide to contact their elected representatives and key members 
of the House Judiciary Committee to ask that they support H.R. 2121, the 
Secret Evidence Repeal Act. (Go to http://thomas.loc.gov. Search for bill

The House Judiciary Committee recently held a hearing to discuss the bill 
and is now considering whether it will go to the full House for a vote. 
Several key members of the committee have not yet co-sponsored H.R. 2121. If 
these members support the legislation, it can pass through the committee 
without amendments.
