Assalamu'alaikum,
Baru-baru ini kita dikejutkan dengan kejadian rogol dan bunuh yang mengerikan di
Melaka. Selepas itu, seluruh masyarakat meluahkan rasa terkejut dan marah diatas
kejadian itu. Ada yang memberikan bermacam-macam cadangan bagaimana perogol itu patut
dihukum. Termasuklah salah seorang pemimpin wanita MCA yang mencadangkan agar perogol
itu dihukum bunuh! Amat selari dengan hukum hudud(?) walaupun MCA sering
memperlecehkan hukum hudud. Terbukti sebenarnya hukum hudud selari dengan naluri
manusia, yakni naluri manusia mahu pesalah dihukum setimpal kesalahannya.
Berkaitan itu, saya terjumpa satu fatwa dari

Question of Fatwa:
What is the punishment for rape? Does rape exist in Islam, ie. does Islam acknowledge
that women have the right to say 'no'. What about slave girls, do they have the right
to reject intimate relationships with thier masters? also, what is the difference
between zina and being with a slave girl? Can a wife demand that her husband be only
sexually invovled with her and no other slave girl? Jazak Allah Khairun.

1) What happens between husband and wife Islamically cannot be called rape. It can be
called forced intimacy. It is incorrect between husband and wife. If a husband forces
his wife, he is is a wrongdoer because intimacy should be on mutual interest and
satisfaction.
A husband should give an excuse to his wife when she has no interest or when she is
tired. However, she doesn't have the right to deny him out or arrogance or putting him
down. There is no punishment for the husband if he goes that wrong way.
2) A rape that takes place between a man and a woman other than the husband is
punishable. The punishment is left to the judge to consider it as perhaps being more
than a crime of zina. It could be included in the category of corruption. In sura 5,
Allah says, "Verily, the only punishment for those those who fight agaisnt Allah and
His messenger and endeavor to corrupt on the earth is to be killed, crucified, having
their right hands and left feet cut off or being exiled from that territory." A rapist
is considered to be a man of corrpution. We could say that he is an outlaw. The
punishment will be assigned by the judge. It could execution, crucifiction, or the
punishmenet of zina.
3) We don't have slaves. When we have slaves, we'll be able to answer your question.
Have in mind that when you are a Muslim, you will have a question for knowledge rather
than argument. This is because if the law is from Allah, we cannot put reason to judge
that law. Reason is always under control of Qur'an and Sunnah.
Any Muslim who wants to put reason as a dominant factor over Qur'an or Sunnah is
getting out of Islam.
