My "i'm not a lawyer" guess is that contacts don't always indicate who
is the copyright holder on works created by third parties.  You would
think this would be something that is clearly stated in the contract
"The party of the second part agrees to release all rights and ownership
of content created during the duration of the contractual period to the
party of the first part.", but sometimes contractors don't want this in
the contract because they want to maintain copyright ownership on
something so that it doesn't get reused over and over in any future
products that are out of the contractors hands (i.e. see the case about
the guy who recorded the "Yahooooooo!" voice over used by Yahoo in their
ads and then didn't receive residual payments for each time Yahoo used
his voice in their future ads).

Like Alfred said, it's best to leave legal matters to the lawyers and
let them fight it out.  If you have any doubts, don't use something
created by someone else.
