That is *not* necessarily the truth.  Even if it were written from
scratch, there are tons of possible patent infringements that could be
going on.  Of course, I'm sure many of them, when challenged, would be
defeated after prior art is shown (I'm sure SCO wasn't *truly* original
in everything it did).  You can patent just about anything, and
technology patents are a very screwy field.  My roommate used to work
for Dell's in house intellectual property department, and I've learned a
lot of things that really reflect poorly on the US, from a perspective
of patents.

US patent law sucks.
