Using any cheat program can result in a ban, no matter the subset of its 
functionality you actually use. If you want to alter cvar values then set 
"sv_cheats 1" for the period you want it altered. Using cheats at any time is a 
violation of the Steam Subscriber Agreement (and always has been).

abuse of a cheat on his own "cheat protected server".

r_3dsky is listed as a cheat cvar by Valve, in this case they are god.
Their game, their code, their choice.
I don't recall why they chose to make it a cheat, and honestly I dont care 
since it has no effect on me.  They made the change intentionally though, 
because it was made a cheat after the release of CSS, probably due to some sort 
of abuse that cheaters/hackers discovered.

Maybe Alfred will answer your question and maybe he won't, and quite frankly 
"He" doesn't have to just because you say so.
