From the details stated in the EULA this is most certainly not
the case. I assume you are referring to the connection limitation
clauses but these explicitly state services they cover, game servers
not being one of them.

I have spoken directly to Microsoft. They have confirmed I am not
allowed to sell / rent game servers running on Windows XP, neither
should I rent dedicated boxes with XP as the host software. The 10
connection limit was a factor but also they highlighted the following
part of the EULA.
"You may not rent, lease, lend or provide
commercial hosting services to third parties with the
Product."
All of the information provided to me currently is saying that companies
providing hosting (including game servers) on Windows XP are breeching
the EULA and are therefore doing so without license. If someone else has
some other information or has been told otherwise by MS please let me know.
I have been thinking of setting up a few boxes with WinXP to test source
on but this is stopping me.
