Mike, I am not a lawyer, and your jurisdiction may vary, but since you
ask for an explanation: technically, I don't think that using a dataset
to check or adjust the position of imagery is enough to make mapping
traced from the imagery a derived work of the dataset (in the sense that
it would convey legal rights).

It means you don't have license to use them in anything else.
I'm working on an idea that will get us license free information which
OSM will be able to use.
I really want to see OSM have a comprehensive map of Samoa as its not
really workable without having that universal access

    so you have some images that can be used and you want to use the other
    unusable images to make the usable ones more usable,
    or am I just confused. please explain
