Talking with The News here on Monday at his office, LHC [Lahore High Court] lawyer Chaudhry Muhammad Farooq, known as CM Farooq, said Ajmal is the real name of the person who is in the custody of Indian security agencies, which had suffixed the epithet 'Kasab' (butcher) to his name. Also the head of an NGO, Voice for the Human & Prisoner's Rights, the lawyer said some of the relatives of Ajmal contacted him in middle June 2007 and apprised him of Ajmal's disappearance in Nepal. He said he prepared the case till February 2008 following which he moved to Nepal. "I filed a habeas corpus [petition] in the Nepal Supreme Court. The Chief Justice of Nepal [Mr. Kedar Prasad Giri] heard the petition and admitted it for proper hearing." He said he had made Nepal's Home Department, Defence Department, Nepal Government and Indian agencies a party in the case. He said he had contacted Nepal Police, its Home Department, United Nation's Human Rights Wing in Nepal as well as all human rights activists, NGOs, embassies of different countries and apprised them about the kidnap of a Pakistani national by Indian agencies. He said the Nepal Government told him that he was making pointless efforts to know the real facts as to Ajmal and the other missing persons and their whereabouts. He said Ajmal's arrest by Indian agency had also been published by the media in Nepal. He said Ajmal's friends apprised the family about his arrest by the Indian authorities. He said Ajmal had gone to Nepal along with his four business partners who used to visit Nepal for business. Besides, he added, there were three to four PIA flights going to Nepal weekly and most of their passengers were businessmen. He said Ajmal's family was contacted by some of those passengers. Farooq said he has evidence about Ajmal's disappearance in Nepal. "I have held a huge press conference in Nepal attended by the international media apprising them about Ajmal's kidnap by Indian agencies." He said the reports about the press conference could be accessed through the Internet. He said the Indian agencies had also kept him under [unlawful] arrest for four hours and [illegally] tortured him in Nepal. To a query as to why it took him so long to make the statement about Ajmal, he said as many as 10 to 20 agencies were calling and asking him about the incident. He said he was scared of the agencies so he was initially reluctant to do so. "My conscience has forced me to come forward and explain the whole situation for the sake of the country [Pakistan], which is under immense pressure," he said. Farooq also claimed that he had seen Ajmal's picture released by Indian media and could clearly recognise it as that of same Ajmal. He said Ajmal has no link with Farid Kot. However, he refused to give any contact number or whereabouts of Ajmal's relatives in Pakistan [because of Indian-Hindu threats to their safety and security]. He said Ajmal Kasab went to the Napalese capital on a business tour. His application regarding his arrest was lying pending in the Nepalese Supreme Court in which a reply was sought from Nepalese forces and Indian High Commission. While talking to the Geo News [TV], CM Farooq Advocate said the Nepalese forces arrested almost 200 people including Ajmal Kasab before 2006 and his application in this regard was lying pending in the Nepalese Supreme Court in which Nepalese forces and Indian High Commission were made respondents. The [Pakistani] Advocate said he wrote letters to Pakistan and Indian governments in this regard. He said that he had also addressed a press conference in Nepal highlighting the issue in which he revealed that the Nepalese forces arrested Ajmal Kasab and many others, and held them at an unknown place and that these people would be used for their ulterior designs at some later stage. He said that he had no contact with Ajmal Kasab ever since he disappeared. The lawyer said he is still pleading the case of Kasab and will visit Nepal towards the end of this month. The Nepalese Supreme Court had repeatedly issued notices to the respondents to furnish their reply but they did not submit any reply. Advocate Farooq said he had filed the petition in the Nepalese Supreme Court in February 2008. He said he isrunning an NGO, Voice of Human and Prisoners Rights, and the parents of Ajmal Kasab contacted him for help in this regard after appealing to the Pakistan Government for help. The people arrested in Nepal had gone there on legal visa for business, but Indian agencies were in the habit of capturing Pakistanis from Nepal and afterwards implicated them in the Mumbai- like incidents to malign Pakistan. The two Pakistani citizens, Asif Ali and Walid Sajjad, had arrived in Kathmandu [Nepal] to explore business opportunities and were staying in Jagat Hotel, near the tourist hub of Thamel in Kathmandu before being picked up by the Nepal Investigation Department on the night of 12th July 2006 "without any apparent reason" or warrant issued against them. They were then reportedly handed over to the Indian intelligence agency at the Embassy of India in Kathmandu. C.M. [Chaudhry Muhammad] Farooq had filed a case against the illegal arrest of the two at the Supreme Court of Nepal under the Interim Constitution of Nepal, 2007, on Feb. 21 [2008]. Following which the SC issued a show cause notice, ordering the authorities to produce the two Pakistani citizens in the court. "At the time of their arrest neither were they involved in any case nor had they violated any honorable law of Nepal. They were legally staying in Nepal on legal visa," Farooq said in a statement issued afterwards. Farooq said that in spite of all the efforts to release the two innocent Pakistani citizens, the only outcome was the access granted by the Indian Government to the Pakistan High Commission in New Delhi [India] to have a meeting with Asif Ali. "It was through that meeting that we came to know Asif Ali was charged/ implicated in a fake FIR [First Information Report of Police] number 59/2006 New Delhi, with different fake cases registered under sections 121, 121-A/ 122, /123/120-B, Indian Penal Code, 4/5 Explosive Substance Act, 18,2-B/23 Unlawful Activities, and 14 Foreign Act," he said. He said that because of shock, the father of Asif Ali had died. He said that Asif Ali was somewhat lucky as he had been located and granted Counsellor Access but his business partner, Walid Sajjad, has been neither produced in any court of law nor his whereabouts are known. "He is probably in the custody of Indian Intelligence agencies," he said. The two Pakistani businessmen dealt in readymade garments and used to regularly travel to Bangladesh and the Middle East. They were also said to have been carrying a substantial amount of money for business purposes. The families of the Pakistani businessmen came to know about the arrest of their dear ones through the media in July 2006, which stated that two Pakistani nationals were arrested on suspicion of involvement in Mumbai train blasts.
