I believe that the way the parser works, once you put quotes around it, it is a phrase search, regardless of whether or not you have something in the quotes that looks like a boolean operator. Are you sure that this only happens with 'and'? There is a known issue with stop words in phrases, and 'and' is by default treated as a stop word. See the bad_word file in your common directory for additional stop words. If I recall correctly this problem arises anytime that a phrase search contains a stop word that is bracketed by non-stop words.
