Thank you for this important communication.
We expect the IADL Executive to give the
highest priority to the issue of the terrorizing
of Defense Counsel before the ICTR and
the reason this has happened .From one trial
to another the pre-conceived theories of
the one sided genocide are being exposed
as a ' selective ' ignoring the collective killings
of others, to promote a theory convenient
for the Security Council appointed Tribunals,
arbitrary from their very inception, as the appointment
and removal of Chief Prosecutors and prosecutors
also establish .
The unity and extraordinary courage of the Defense
Counsel of the International Criminal Tribunal
for Rwanda has to be commended ,as it is
the unity of this Bar which has enabled facts
to slowly emerge despite the international propaganda
of the global media representing special financial interests.
A significant factor in the threats and assassinations
of these Defense Counsel is that there is a serious
and systematic attempt to prevent the truth from
emerging, as in many cases they represent those
who are innocent and victimized to promote an
officially political line adopted by a coterie
in power , supported by the Security Council, which
desires an official political version as against the
TRUTH AND REALITY of what has really happened
in these regions from former Yugoslavia , to Iraq ,
to Rwanda , to the so called special tribunal investigating
the assassination of former Prime Minister Hariri to
the warrants issued against the President of Sudan
among other cases .
I had already informed you of the increasing threat
to Defense Counsel , in many countries including
in India where a young lawyer Shahid Azmi was
assassinated for defending those WHO WERE
WERE INNOCENT falsely charged with terrorist
related offences , in the main poorer sections of
the minorities . The discharge /acquittal from case
to case of these accused persons posed a threat
to the covert political propaganda of fascist and
covert groups selective targeting a particular
community for demonizing to fracture the body
politic and create divisions .During the same period
other lawyers were assaulted , threatened , shot
at or otherwise victimised for revealing the truth .
Earlier I myself faced an extensive period of harassment
lasting almost a decade and a half , when attempts were made
to disrupt my work , impose isolation , with illegal surveillance
over all communications , telephonic , e mail and otherwise by
covert agencies , with many used as a part of the ring of
surveillance . This was related to the nature of my work .
Mahatma Gandhi taught us that the pursuit of TRUTH is
'Dharma '.The word stands for both 'Justice
and ' Religion'.
The terrorizing of the Defense Counsels of
Rwanda has serious implications for the already
fractured existing International system of justice ,
imposed through Security Council appointed tribunals ,
exposed now as a reign of terror against Defense
Counsel , to advance pre-planned theories through
special tribunals, to camouflage externally imposed
genocide of more than one group , civil wars , civil strife ,
aggression through incessant bombings and occupation
of countries and regions for seizure of resources,
imposing a NEW MILITARY ORDER or proxy political order for
pillage or monopoly control of minerals, hydrocarbons,
drugs among other raw materials and control of
strategic regions .
In this context the so called International Tribunal for
LEBANON to investigate the assassination of former Prime
Minister Rafiq Hariri, has shifted the needle of suspicion three
times depending on the political purpose to be served.
First against the highest Intelligence officials of Syria ,
then against very senior officials of Lebanon and NOW
against members of the National Resistance against
Israel headed by the Hezbollah with the intention of
fracturing national unity and the Resistance and taken
no action against false witnesses deposing to advance
these conveniently alternative theories to fracture
Lebanon .
The Memorandum of the Defense Lawyers
of the International Criminal Tribunal for Rwanda
must be supported before every forum and institution.
If the Tribunal collapses due to these conditions in which
the Defense Lawyers cannot function , the accused persons
already incarcerated for several years ,will have to be enlarged
on bail pending future trial or general amnesty declared depending
of what the Defense Counsel at ICTR have recommended .
Kindly circulate to the Executive of the International
Association of Democratic Lawyers and to
lawyers associations in the Arab world and
Africa , to the American Jurists Associations and
to Associations in Europe among others , as often
