Dear Colleagues,
My communications on the serious miscarriage of justice in the trial
and conviction of Dr.Binayak Sen have in all probability not been received by
you due to obstruction and possible censorship .To repeat what was stated by me
in the communication :-
1. Dr.Binayak Sen's conviction will be seen by citizens in particular those
without access to justice as a confirmation of their belief that whereas
Companies and political leaders who unleashed the vigilante Salwa Judum on
innocent Adivasis driven from their hearths and homes have been conferred
impunity , a doctor and a Gandhian who has adhered devotedly to the medical
ethics enjoined by the Hippocratic oath has been framed by the government of
Chhattisgarh committed to evicting
the Indigenous people of India and the peasantry from the villages in which
they have lived from time immemorial in collusion with Indian and Multinational
Companies .
2. At all times in prison Dr.Binayak Sen met the prisoner whom he was treating
at the request of his family members in the presence of the jailors and prison
authorities and with their prior permission.
3. Planted documentation not seized from the custody of an accused person , are
tainted and can never be used in a fair trial , the state prosecutors are
increasingly resorting to tainted evidence for framing innocent persons who
have exposed tainted political and corporate leadership and their shenanigans
relating to illegal seizure of minerals and natural resources apart from the
pillaging of the national exchequer for personal gain .
4. There is no case whatsoever for conviction for Sedition , no clear and
present danger, no acts of violence and no aid or support given to any unlawful
organization , what was extended was medical assistance after necessary
permission was obtained from the Prision authorities .
5. Serious acts of Sedition are not being prosecuted committed by corporate and
political interests for example despite the remarks by the Supreme Court that "
war cannot be declared on our own people" who have been left out of essential
development activity , Mr.Nitin Gadkaris is seeking the assistance of a foreign
government , namely the government of Israel to initiate a civil war against
our own people as head of a BJP delegation to Israel which was recently
reported.This is Sedition and has serious consequences for the integrity of the
country .
6. When the innocent are jailed and the guilty representing the rich and
powerful at large what will be the impact on democracy and democratic
institutions and the Rule of Law ,if it is claimed that this applies equally to
those who exploit and to those exploited by existing economic,political and
social conditions when those who represent adivasis , dalits, minorities , the
working people and the peasantry are convicted and even assassinated as in the
case of Advocate Shaheed Azmi It is being reported from Raipur by lawyers that
thousands of Adivasis are under arrest , tortured and illegally detained and
hundreds of villages forcibly emptied .
7. There is a break down of the Constitutional system in Chhattisgarh which
must be widely reported while working for the National Campaign to ensure
justice to Dr.Binayak Sen and all those illegally detained and convicted for
opposing seizure of peoples resources in the affected regions, this is the
minimum Mahatma Gandhi would have expected of us a nation wide andolan to focus
attention on illegal detentions and convictions of those resisting seizure of
resources and those working for justice for working people, the peasantry ,
adivasis , dalits, minorities and socially and economically backward groups ,
IT IS DR.BINAYAK SEN AND ADVOCATE SHAHID AZMI TO-DAY AND THE REST OF US
TO-MORROW .WE HAVE TO RESCUE INDIAN DEMOCRACY FROM FINANCIERS ,COMPANIES AND
THEIR POLITICAL REPRESENTATIVES AND
RESTORE DR.AMBEDKAR'S CONSTITUTION MAKING THE DIRECTIVE PRINCIPLES OF STATE
POLICY ENFORCEABLE
BY LAW WITH ONE HOUSE OF THE PARLIAMENT AND THE STATE LEGISLATURES REPRESENTING
CITIZENS CLASSIFIED
AS PER OCCUPATION .
