 toGujarat police witch hunting tactics

Dear Colleagues committed to the defence of human rights,

Everyone must exercise absolute vigilance in the days ahead as there is a
clear and present danger that anti-democractic forces are rasing their hood for
an outright assault on constitutional rights and will stop at nothing. This was
clear from the assassination last year of Advocate Shahid Azmi who had defended
scores of innocent youth falsely framed in cases of bomb blasts carried out by
covert organizations ( Kindly read the report in Tehelka of the individuals and
organizations involved ) and the PRESENT WITCH HUNT AGAINST DR.BINAYAK SEN .

It is in this context that the communications in respect of TEESTA SETALVAD
AND RAHUL SINGH AND OTHER CASES MUST BE TAKEN VERY SERIOUSLY AND IF NECESSARY
AFTER OBTAINING LEGAL ADVISE CRIMINAL COMPLAINTS OF THREATS AND INTIMIDATION
AND WHEREVER NECESSARY ANTICIPATORY BAIL BE OBTAINED .HOWEVER THROUGHOUT THE
LENGTH AND BREADTH OF THE COUNTRY CONFERENCES , SEMINARS AND PUBLIC MEETINGS BE
HELD ON THE THREAT TO DEMOCRATIC RIGHTS OF THOSE SEEKING TO IMPLEMENT THE
CONSTITUTIONAL RIGHTS OF THE OPPRESSED IN THE COUNTRY WITH THOSE POLITICAL
PARTIES PARTICIPATING IN SUCH NEFARIOUS ACTIVITIES TO BE EXPOSED INCLUDING THE
LEADERS INVOLVED ALONG WITH THE SOURCE OF THEIR FUNDING . AS IS CLEAR FROM THE
RADIA TAPES IT HAS BEEN DECLARED THAT SOME POLITICAL RIGHTS HAVE BEEN REDUCED
TO SHOPS OF CORPORATE BACKERS .

Wherever possible democratic members of the legal profession and honest
retired sections of the judiciary be associated with the conferences to be held
as a war is on against democratic and constitutional rights of honest citizens
in more than one region of the country and on citizens like Dr.Binayak Sen
who are committed to the implementation of the Rule of Law who expose covert
organizations such as Salwa Judum .TEESTA AND RAHUL SINGH ARE BEING THREATENED
AND INTIMIDATED FOR BEING IN THE VANGUARD OF THE MOVEMENT TO HAVE THE GUILTY
MEN AND WOMEN OF THE GUJARAT POGROM EXPOSED .
FROM ONE REGION TO ANOTHER DRAW UP AND INFORMAL LIST OF RETIRED MEMBERS
OF THE JUDICIARY TO JOIN THE NATIONAL CAMPAIGN FOR THE PROTECTION OF
CONSTITUTIONAL RIGHTS AND IN DEFEENCE OF DEMOCRACY SOUGHT TO BE ERODED AND
GRADUALLY DESTROYED .

This must be a NON SECTARIAN CAMPAIGN HOWEVER KEEP OUT THOSE WHO
ARE DIRECTLY OR THROUGH THEIR POLITICAL FORMATIONS RESPONSIBLE FOR THE ATTACKS
ON CONSTITUTIONAL RIGHTS AND VIOLENCE ON WORKING PEOPLE , ADIVASIS, DALITS ,
THE PEASANTRY , SOCIALLY AND ECONOMICALLY BACKWARD GROUPS AND MINORITIES AND ON
THOSE INTELLECTUALS AND OTHERS WHO SUPPORT THEIR JUST CAUSE .

DR.BINAYAK SEN IS REQUIRED TO BE BAILED OUT IMMEDIATEL AFTER CONSULTION
WITH HIS LAWYERS ON THE FOLLOWING AMONG OTHER POSSIBLE . GROUNDS:-

1 NO PRIMA FACIE CASE EXISTS AS PER THE RECORD, EVIDENCE OF JAIL AUTHORITIES
AND TAINTED EVIDENCE APART FROM THE SERIOUS FLAWS IN THE PROSECUTION CASE WHERE
THE INDIAN SOCIAL INSTITUTE WAS AS PER THE PROSECUTION'S RIDICULOUS SUBMISSION
THE PAKISTAIN ISI ETC..

2. DR.BINAYAK SEN IS UNSAFE IN THE CUSTODY OF THE CHHATTISGARH GOVERNMENT WHERE
EARLIER EVEN THE NECESSARY MEDICAL ASSISTANCE WAS NOT SUPPLIED ON A TIMELY
BASIS FOR HIS MEDICAL CONDITION.

A SYNOPSIS OF THE NATURE OF EVIDENCE LED AGAINST DR.BINAYAK SEN BE DRAWN UP FOR
USE IN THE MEETINGS TO BE HELD ALONG WITH A REPORT ON THE HUMAN RIGHTS SITUTION
FROM ONE REGION TO ANOTHER .

SIMULTANEOUSLY COMMENCE DRAWING UP LISTS OF OFFICIALS AND NON OFFICIALS
RESPONSIBLE DIRECTLY OR COVERTLY FOR THE VIOLATION OF HUMAN RIGHTS , TORTURE,
IMPRISONMENT AND KILLINGS .IN ARGENTINA MILITARY AND OTHER OFFICIALS AND
POLITICAL LEADERS AMONG OTHERS ARE BEING PROSECUTED FOR CRIMES COMMITTED AFTER
THE MILITARY COUP AFTER DECADES . ALL EVIDENCE AND RECORDS TO BE CAREFULLY
MAINTAINED FROM CASE TO CASE NOT WITH ONE INDIVIDUAL BUT CIRCULATED AMONG
MANY,HUNDREDS AND THOUSANDS OF PEOPLE. KINDLY CONSULT FORMER CHIEF JUSTICE
RAJINDER SACHAR AMONG OTHER RETIRED JUDGES

INCLUDE THE ISSUES OF ALL THOSE BEING INTIMIDATED FROM ONE REGION TO ANOTHER
IN A SPECIAL LIST TO BE PRINTED AND CIRCULATED FROM CONFERENCE TO CONFERENCE
INCLUDING CLASSES AND CATEGORIES OF PERSONS BEING VICTIMISED WITH THE BRIEF
REASONS FOR THEIR VICTIMISATION TO MAKE IT CLEAR THAT THE PERSECUTION IS
DIRECTLY RELATED TO AN ATTEMPT TO ENFORCE EXISTING CONSTITUTIONAL AND STATUTORY
RIGHTS AND THE EXISTING LAW WHICH THE POWERFUL WISH TO DEFEAT MISUSING POLICE
POWERS .
                          NILOUFER BHAGWAT
