I support all steps to be taken to protect the civil liberties of Teesta
Setalvad ,Rahul Singh and other activists .It would be prudent to immediately
move the Court/Human Rights Commission or both seeking different remedies , to
protect them against arbitrary detention, interrogation and arrest on the prima
facie ground that this is a mala fide step and malicious prosecution by the
state government of Gujarat, including fabrication of evidence and documents
for misuse in legal proceedings against the individuals who have now been
subverted by the Gujarat government.I have gone through a different but similar
experience of harassment and this has to be exposed by the media, press and TV
as well, apart from in public meetings. Teesta must be having a record of the
nature of the participation of this turn coat activist and his activities which
are necessary to cite .Get all the details for the expose .This time round
there may not be evidence of bank accounts but other eviden
ce of the nature of the subversion.

The malicious prosecution of Teesta Setalvad will once again focus attention
on the nature of operation of the fascist forces and their financiers just as
the unjust conviction of Dr.Binayak Sen has resulted in a country wide
revulsion against the methods adopted to pursue land and mineral seizures of
the weakest sections of society by adopting the cruelest methods akin to not
only to confiscation of the subsistence resources of the Adivasis and the
peasantry and resorting to torture ,collective killings , destruction of
livelihood and homesteads and confiscation and destruction of their ecology and
water resources .

Neither is the treatment of minorities , adivasis , the peasantry , dalits
and working people democratic on the other hand those seeking the enforcement
of the constitutional rights of these sections and classes are sought to be
suppressed by threats and intimidation and unjust convictions.

If possible Dr.Binayak Sen and Teesta , Rahul Singh and others be
represented by 10 t0 15 eminent lawyers and retired Judges before each forum
and observers that is eminent journalists and members of the public be invited
to observe proceedings .Keep the identity cards of everyone who desires to
attend proceedings ready so that they are not obstructed from attending the
trial/proceedings .
In these cases the Courts of these State governments can hardly be
expected to be objective and the Judges themselves may be under intimidation of
one kind or another .

                         Niloufer Bhagwat
