The fact that SC has ridiculed the evidence & arguments of the state
of Chhatisgarh , that have resulted in the conviction of Binayak ,
has lent full credence to the civil society's arguments that the trial
of Binayak Sen was always about sending a tough message , " look this
can happen to you too" " see what we can do to you " to those
opposing the salwa-judam crimes of the state & nothing more . The
SC too is questioning the logic of the state arming its people against
people & relinquishing its authority . Will the state ever question
the crimes of the people it arms ?

As the state of Chhatisgarh has carried out the trial of Binayak in
full view of the world including EU observers , we can conclude that
in a country that likes to call its self the world's largest
democracy , we have pretty big sized pockets where human rights of the
citizens are about as safe as in Burma. We have a police that can
create evidence & kangaroo courts that can interpret the laws of the
land to please their masters....to hell with the constitution.

We may be a votecracy , notecracy or cleptocracy , but democracy we
are not in any way yet .
