Tiga perusahaan penambang asing yang disebut oleh Amien adalah Newmont Minahasa, Freeport, serta satu perusahaan di Papua yang tak disebutkan oleh Amin. Hal merigukan negara yang telah dilakukan oleh perusahaan asing tersebut, menurut Amien, adalah soal bagi hasil, di mana penambang mendapat 85 persen, sedangkan negara hanya mendapat 15 persen. Kerugian materi yang dialami negara yang lain adalah, perusahaan tersebut membayar pajak jauh lebih kecil dibanding seharusnya. Hal lain adalah dampak lingkungan yang ditimbulkan. Menurut Amien, berdasarkan sebuah laporan, akibat penambangan yang dilakukan Freeport, lahan seluas 200 kilometer di Timika, Papua, menjadi tandus gara-gara pembuangan limbah. "Jadi, fraksi-fraksi di DPR harus lebih responsif terhadap masalah-masalah tersebut. Masalah pertambangan adalah skandal raksasa. Kalangan DPR harus harus membidiknya," kata Amien di Semarang, Jumat (6/1). Selama ini, lanjutnya, hanya Fraksi PAN dan Fraksi PDIP saja yang bersuara nyaring soal ketiga perusahaan tersebut. "Jangan mengutak-utik masalah biaya telekonferensi presiden saja. Itu masalah kecil. Masalah pertambangan ini jauh lebih penting, lebih besar dibanding kasus BLBI," kata Amien. The conclusion came from a study by Commission VIII of the 500-member House during a visit the remote region early this month. It said the U.S.-Indonesian venture has been exploiting gold and copper for 25 years but leaving people in the area in poverty. In its report before a plenary meeting of parliament, the commission said such a condition has raised dissatisfaction from the local people, and therefore the operations of the giant mining company should be re-evaluated. There are demands for Freeport to apply "justice feeling" for the sake of the local people through a profit sharing, the commission said. It suggested that demands for the profit sharing should be included in negotiations for the contract. A study in 1996, by Labat and Anderson, an international auditor, found that Freeport was not responsive to the social needs of neighboring tribes in the remote Indonesian province of Irian Jaya. In March the same year, three people were killed during rioting by tribes people in Timika and the mining town of Tembagapura. The rioters were demanding more economic benefits and job opportunities from the mine. It said Freeport has met "both the letter and spirit of Indonesian law" concerning local people's land rights, but it should do more to understand and work with the local indigenous leaders because of their markedly different cultures and perception of land issues. Freeport then welcomed the criticisms and suggestions by Labat and Anderson, which made an independent audit of its social and cultural impact in the jungle region. The report concluded that Freeport has spent $100 million in the last seven years on community development and social programs and that it also contributes hundreds of millions of dollars annually in taxes and royalties to the government of Indonesia. Freeport Indonesia, which began operations there in Timika since the 1960s, is a joint venture company whose 81.28% share is controlled by the New Orleans-based Freeport-McMoRan Copper and Gold Inc. (FCXA).
