Mungkin ini akibat tidak dilaksanakannya Amar Putusan MK.
Ketua MK, Akil Mochtar menilai SKK Migas yg dibentuk pemerintah untk menggantikan BP Migas adalah instansi yg 100% sama. BP Migas dibubarkan oleh MK pada 2012 krn dianggap sebagai inefisiensi yg melanggar konstitusi. Akil menilai, pemerintah tdk mengikuti pesan yg disampaikan MK saat membubarkan BP Migas. Pesan MK dlm putusannya : "kedaulatan harus dikembalikan ke negara, yg diwakili pemerintah, utk secara langsung menguasai sumber daya alam bagi sebesar2 kemakmuran rakyat". Jadi tidak spt konsep BP Migas, yaitu ada stakeholder. Kmd negara tidak ikut campur ke sana, hanya menyerahkan ke stakeholkder saja, kata Akil.
