There was a time when IBM had language in the license agreement that allowed the license to be transferred to another computer. What some within IBM viewed as a loophole was changed. However, the agreements in place could not be unilaterally changed by IBM.
IF PSI had such an agreement in place -- and I do not know whether they did or did not -- that license could be transferred to another machine. Then the legality would turn on the language of the agreement concerning the "machine" the operating system was licensed to execute upon. It looks like much speculation is just that. The courts will ferret out all of these details and a decision will be rendered. We don't know all the particulars, so we can't know what the outcome will be in this case. It does however make for a discussion that just keeps on giving even when you think you have reached a point that nothing else could be said that hasn't been said. My understanding was that IBM licensed PSI to run z/OS on a "designated" real IBM mainframe.
