If the dominance test can fail for Apple in the mobile phone market, it can also fail for IBM in the IT market. Since one of PSI's complaints against IBM is of tying the use of z/OS to the purchase of IBM hardware, perhaps one of their lawyers should nip over to Hamburg and have a chat with a suitably qualified Rechtsanwalt? (I could suggest a couple of names, if pressed.)
