Since there are no files to access, and no possibility to add files, an
access would make no sense, so the designers of CP-67 decided this
should be an error.

You can access a r/w empty minidisk because there is the ability to add
files.

Not that I know of.  You just have to catch the rc=28 and handle that as
an error.
