First, I am NOT a lawyer and I don't pay one on TV, but my understanding of the M3K microcode, and OS/2 support system licensing is that they are part of the system and can be legally transferred (i.e., sold) to another party. what you can not transfer is an operating system license like z/OS or z/VM. The buyer would have to go directly to IBM to license those.

Well, right now it does, but should it?
Is the microcode, which is licensed by IBM, licensed to the box, or to the 
customer?
Is it transferable?

All the internal dasd was formatted over.
Should the OS/2 dasd been formatted over also?

We don't want to be in violation of some agreement that no one actually reads
