Mp3 codec is covered by software patents. We have Free Software that
implement mp3 codec. So except in the USA these implementation is legal.
Though Free Standards are preferred, we have reverse engineered the mp3
format and there is nothing preventing anyone using mp3s in India. Mp3
codecs are legally safe in India, because we don't allow software to be
patented. But the real question about distribution is copyright, and as
Aneesh mentioned, it is same for both mp3 and ogg.
