That depends on the precise nature of the patent. Every time you add/delete/rename a file you are using aspects of the FAT filesystem. For example, according to some interpretations of the MP3 patent, even decoding an MP3 using floating point processing requires a license to use the patented technology. In that case, the software that does this comes with your MP3 player and so it _is_ the manufacturer's problem. But your pen-drive does not contain the FAT filesystem software.
