the key item here is to prove to Network Solutions/Verisign, with documentation (faxes, passports, drivers license, and three Ave Marias), that your are the registrant for the domain of the NS record. ie, you are registrant for domain.com so you have authority over the ns1.domain.com A record. It is only the domain registrant that can create/modify hostnames under the domain.
