Which tests is the backup server failing? The only one I can think of might be the relative addressing one where the send a message in a format like this user@somedomain!yourdomain. This is not really a failure but will look like one to them because the message is accepted by the server for delivery to yourdomain but should bounce trying to go out of yourdomain server if it is setup correctly. In most cases if you contact them an tell this is being used as a backup/gateway and the message is not getting delivered to the final destination but will bounce they should take you off the list.
Here is the message flow for better understanding Message addressed to someone@somedomain!yourdomain is accepted by the backup server for yourdomain. This server should be set up to "relay for addresses" with the IP of the primary server in the addresses table and in the HOSTS file pointing to yourdomain. This will get passed on to the primary. The primary should not be setup to relay for the backup (this might be where you went wrong). The message gets to the primary and if it isn't a local delivery (which it isn't, it will try to deliver to the original someone@somedomain) at this time, if the primary is not set to relay for the IP of the backup machine, the message will bounce. ORDB considers your backup machine an open relay just because it accepted the mail for delivery. This is an invalid assumption on their part as the mail will be bounced but, delayed and when presented with the case of how it works they usually relent and take you off the list.
