Since they think you are a DUL, their probes may be qualifying you as a non-open-relay DUL now so they will accept mail from you in the future. They may be doing you a favor by pre-emptively whitelisting your IP.
They told me that they had the right to do so as long as it is clear that the probe is an open relay test.
When you run a public mail server and openly accept connections from all of Internet, what rights Internet has or doesn't have to connect to your server is pretty fuzzy. In perspective, a known MTA connecting to you for non-denied, non-abusive purposes is not even on anyone's "SMTP problem" radar.
