As I am here looking, declude is always right under the system idle process, or at times above it.... it appears that declude is causing the issues here
I highly doubt it.
The only indication that Declude is causing the issues here is that you are seeing Declude processes use 20%-50% CPU at peak times (versus ~5% during non-peak times). If the CPU isn't at 100%, it is virtually impossible that you'll encounter problems related to that. If you aren't at 100% CPU usage, there should rarely be any delays noticeable by end users.
I would first double-check that you don't have a F-Prot.exe file on your server. If you do, go to whoever told you they removed it from the system, and start asking questions. Those questions will almost certainly lead to the answer to the problem you are experiencing.
If there is no F-Prot.exe file on the server, the next step would be to see why Declude is using so much CPU time. For that, I would recommend sending some information either to our support@ address or the Declude JunkMail mailing list. Specifically, we would be interested in knowing the number of E-mails your server sends/receives per day, the CPU (1 3Ghz CPU), and any tests that you run in Declude JunkMail (the lines from your global.cfg file where they are defined would be most useful). I doubt that Declude using that CPU time would cause the problem, but it can't hurt to rule it out.
